Texas Federal Judge Andrew Hanen decided on August 31st to reject AG Ken Paxton’s request to halt renewals of the protections from deportation that allow DACA beneficiaries to live and work in the US legally.
In considering the significant value that the Dreamers have been providing to our economy, Hanen decided that the costs of ending their protections would outweigh any benefits. "Here, the egg has been scrambled,” he said. “To try to put it back in the shell with only a preliminary injunction record, and perhaps at great risk to many, does not make sense nor serve the best interests of this country.”
This is good news! Perhaps Hanen has been listening to the Texas business community. The amicus brief Vincent and Elkins L.L.P. drafted on their behalf did a great job highlighting the valuable contributions the Dreamers provide.
The judge also noted that this is an issue that needs a legislative solution. This is not an issue for the courts!
"DACA is a popular program and one that Congress should consider saving,” Hanen said. However, "this court will not succumb to the temptation to set aside legal principles and to substitute its judgment in lieu of legislative action. If the nation truly wants to have a DACA program, it is up to Congress to say so."
Amen to that! Now it’s time for our lawmakers to pass legislation that secures the border and provides a permanent way to properly ID and Tax these individuals, as President Donald Trump has been asking since his election!
